LEGAL NOTICE OF PUBLIC HEARING

Pursuant to established procedure, NOTICE IS HEREBY GIVEN that the Payette County Planning and Zoning Commission will hold a public hearing in the County Courthouse on Thursday, June 10, 2021. Each hearing will be held during the allotted time below or as soon thereafter as it may be heard. We invite interested parties wanting to observe the hearings to watch the proceeding live on PayetteCountyID Facebook page. The purpose of the hearing is to consider applications for the following:

7:00 P.M.

I-Conditional Use Permit- Winery: Application is made by Michael Van Patten and Harold Curtis Van Patten. Parcel is owned by Michael Van Patten and Janie Mori, 3767 Sand Hollow Road, New Plymouth, Payette County, Idaho. I-Rezone- A-Agricultural to I-2- Heavy Industrial : Application is made by Jalopy Jungle. Parcel is owned by SI & JI Family, LLC, PO Box 311, Payette, Payette County, Idaho. Subject parcel is located on Hwy 95/S. 16th St., adjacent to and south of 1025 S. 16th Street, Payette, Payette County, Idaho. 

     The subject parcel is described more specifically as:

A portion of land identified as: Tax 7 of Blk 45 Westslope Plat, Boise Meridian, Payette, Payette County, Idaho.

I-Amendment to Payette County Code § 8-2-2: Meaning of Terms or Words: Addition of a definition: Dwelling Unit, Accessory: A second single-family dwelling on a shared lot, also known as an Accessory Dwelling Unit (ADU). 

II-Amendment to Payette County Code § 8-8-2: Zone A (Agricultural): Amend section B.1. by adding to permitted use the provision for one accessory dwelling unit with certain restrictions. 

III-Amendment to Payette County Code § 8-5-10: Transfer of Development Rights; Nonqualifying Parcels: Amend section L by changing the required notice of public hearing area from landowners who own property within three hundred feet (300’) of the receiving parcel to landowners who own property within one thousand feet (1000’) of the receiving parcel. 

IV-Amendment to Payette County Code § 8-9-6: Procedure For Hearing Notice: Amend section A.2. by changing the requirement for written notice by mail from three hundred feet (300’) to one thousand feet (1000’).

The hearing officer shall be authorized to impose a 5-minute limitation on any oral testimony. If testimony is anticipated to exceed that 5-minute limit, it may be submitted in writing in advance to the Planning and Zoning office to be part of the record. Written testimony, exhibits and/or any documentation to be made a part of the hearing record and considered by the Commission must be submitted by 5:00 P.M. on June 3, 2021 to the Planning and Zoning Department at the address above or emailed to This email address is being protected from spambots. You need JavaScript enabled to view it.. Written information presented at the hearing will be placed in a sealed envelope and will not be considered. The record will be open for public viewing at the Planning and Zoning Office located at the Payette County Courthouse, Payette, Idaho during regular business hours.

Any person needing special accommodations to participate in the above noticed meeting should contact the Planning and Zoning Administrator's office at the County Courthouse seven days prior to the meeting.

NOTICE IS HEREBY GIVEN the Payette County Planning and Zoning Commission will meet the second Thursday of each month in 2021 as scheduling permits, except for the months of August and November when the meeting will be held the third Thursday. The meetings will be held at the Payette County Courthouse, 1130 3rd Avenue North, Courtroom #1, Payette, Idaho starting at 7:00 P.M.
